New Zealand resident beneficiaries of Australian Trusts

Recently, there has been an Australian Court case that confirmed the tax implications of capital gains that are distributed to non-resident beneficiaries, eg. New Zealand resident beneficiaries.

The result from this case is that if a New Zealand resident beneficiary receives a distribution of a capital gain from an Australian resident trust then the beneficiary would be taxed on this capital gain in Australia.

Be careful when receiving distributions from Australian trusts. It may be that you're liable for tax in Australia when you previously thought you were exempt.
